1. Acceptance of Terms
By accessing and using the Velaix platform, you agree to comply with and be bound by these Terms of Service, which govern the relationship between you (user) and Velaix. If you do not agree with any part of these terms, you must cease use immediately.
2. Description of Service
Velaix provides software as a service (SaaS) focused on automation and artificial intelligence, including, but not limited to, autonomous agents, data analysis, and social media hubs. The service is provided 'as is' and 'as available'.
3. Eligibility and Accounts
To use certain features, you must create an account. You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Velaix reserves the right to suspend accounts that violate these terms or exhibit suspicious behavior.
4. Intellectual Property
All content, algorithms, design, and software of Velaix are our exclusive property or that of our licensors. Use of the platform does not grant you any intellectual property rights over the underlying software.
5. Content and AI Outputs
You retain the rights to the data entered. However, the results (outputs) generated by AI are auxiliary tools. Velaix does not guarantee the accuracy, utility, or legal suitability of any AI-generated content, and it is the user's total responsibility for final review and validation before any public or commercial use.
6. Prohibited Uses
It is expressly forbidden to: (a) Attempt to reverse engineer the software; (b) Use the platform to generate illegal, hateful, or abusive content; (c) Use unauthorized data mining robots; (d) Infringe on the intellectual property rights of third parties through the platform.
7. Payments and Cancellation
Plan subscriptions are based on a recurring model. Late payment may result in immediate suspension of access. Cancellation can be made at any time through the dashboard, but there will be no refund for periods already paid, except where required by law.
8. Limitation of Liability
To the maximum extent permitted by law, Velaix shall not be liable for lost profits, data loss, or indirect damages resulting from the use of the service. Our total liability in any claim is limited to the amount paid by the user in the last 6 (six) months of subscription.
9. Indemnification
You agree to indemnify and hold Velaix and its employees harmless from any claim, loss, or demand arising from your misuse of the platform or violation of these terms.
10. Jurisdiction and Governing Law
These terms are governed by the laws of the Federative Republic of Brazil. The court of the District of Barueri - SP is elected to resolve any dispute arising from this instrument, excluding any other, however privileged it may be.
